1. Introduction
These Terms of Service ("Terms") form a legally binding agreement between you ("User," "you") and Mechaverse (Mecha Labs Inc.) ("we," "us," "our"). By accessing, registering, or using our services, you agree to comply with these Terms. If you do not agree, please do not use Mechaverse.
2. Acceptance of Terms
By accessing or using Mechaverse in any way, including creating an account through Google or GitHub OAuth, you agree to these Terms and our Privacy Policy. Continued use of the platform indicates acceptance of any future changes to these Terms (see Section 14: Changes to Terms).
3. Eligibility and Age Restrictions
Mechaverse is intended for professional and educational use by robotics practitioners. Mechaverse is available to any user capable of entering into a binding agreement under applicable law. By using the service, you represent that you have the legal capacity to do so. By using Mechaverse, you represent and warrant that you meet these requirements.
4. User Accounts
To access most features, you must create an account via Google or GitHub OAuth and select a unique username. You are responsible for maintaining the confidentiality of your login credentials and any activity under your account. You must provide accurate information during registration and keep your account information up to date. We reserve the right to suspend or terminate accounts that violate these Terms.
5. User Conduct and Acceptable Use
You agree to use Mechaverse responsibly. You must not:

Engage in any illegal, harmful, or fraudulent activity.

Violate our Content Policy or Code of Conduct (which provide guidelines on acceptable content and behavior).

Upload, share, or distribute content that is offensive, abusive, defamatory, or otherwise violates anyone’s rights (including intellectual property rights).

Attempt to gain unauthorized access to the platform, other users’ accounts, or our systems.

Interfere with or disrupt the security, functionality, or performance of Mechaverse (for example, by distributing malware or engaging in denial-of-service attacks).

Use Mechaverse to transmit or store any malware, spam, or other harmful or unsolicited content.

Use any automated means (such as bots, scrapers, or spiders) to access, query, or collect data from the platform without our prior permission (except for standard search engine indexing).
We may remove content or restrict accounts at our discretion if we believe these rules are violated.
6. Intellectual Property
Our Content: All materials on Mechaverse, including code, logos, design, and features, are owned by Mechaverse and protected by intellectual property laws. You may not copy, modify, distribute, or exploit our content without written permission.
Your Content: You retain ownership of any robot images, metadata, bios, code, or other content you upload to Mechaverse. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to host, use, copy, display, and share your content as necessary to operate and improve the platform. For example, this license allows us to store your content on our servers, make backup copies, modify it as needed for technical reasons (such as formatting or compressing files), and display it to you and other users (including through search results or previews). This license is solely for the purpose of operating and providing our services – it does not grant us ownership of your content, and we will not use your content outside of our service without your permission. You are solely responsible for ensuring that your content does not infringe on others’ rights.
7. Public Content and Licensing
Public Access: Any content that you make public on Mechaverse will be visible and accessible to other users of the platform (and potentially to others on the internet).
License to Other Users: By marking content as public, you give each user of Mechaverse a non-exclusive, worldwide license to use, view, and display your public content through the platform’s functionality (for example, to view your robot or to run or duplicate your shared project). This license to other users only allows use of your content within Mechaverse – it does not grant anyone rights to use your content outside of Mechaverse.
Optional Licensing for Reuse: If you want to allow others to copy, modify, or use your public content outside of Mechaverse, you should include an appropriate license or permission with your content (for example, an open-source license for code or a Creative Commons license for media). Unless you expressly provide such a license, you retain all rights to your content, and other users may only use or share your content on Mechaverse as permitted by these Terms or applicable law.
Third-Party Rights: Only upload content that you have the right to share. If your upload includes material owned by someone else or subject to a third-party license, it is your responsibility to ensure you have permission to use it and (if public) to allow others to view and use it as described above.
Removal of Public Content: If you delete content that you have made public (or if your account is deleted), that content will no longer be available to others through our platform. However, if other users have already forked or copied your content within Mechaverse, their copies will remain accessible to them (and will remain subject to these Terms and any license that applied to the content). We are not responsible for any use of your public content by others who obtained it before it was removed.
8. Payments and Fees
Mechaverse is currently free to use. If we introduce paid features or subscriptions in the future, we will update these Terms and provide notice before charges are applied. At that time, payment methods, refunds, and cancellation policies will be clearly outlined.
9. Additional Policies
Your use of Mechaverse is also governed by other policies that are incorporated into these Terms, including our Privacy Policy, Content Policy, and Code of Conduct. We may also introduce new policies from time to time (for example, cookie notices or community guidelines), and by continuing to use the service, you agree to comply with any such additional policies.
10. Third-Party Links and Services
Mechaverse may contain links to third-party websites or use third-party services (e.g., Google Cloud, GitHub, Google Analytics). We do not control these third parties and are not responsible for their content, policies, or practices. Use of third-party sites and services is at your own risk.
11. Disclaimer of Warranties
Mechaverse is provided on an “as is” and “as available” basis. We make no warranties, express or implied, about:

The reliability, availability, or accuracy of the platform.

That Mechaverse will be error-free, secure, or uninterrupted.

That content uploaded by users will not be lost or corrupted.
Use Mechaverse at your own risk. We disclaim all warranties (including implied warranties of merchantability, fitness for a particular purpose, and non-infringement) to the fullest extent permitted by law.
12. Limitation of Liability
To the maximum extent permitted by law:
- Mechaverse shall not be liable for any indirect, incidental, or consequential damages, including loss of data, profits, or reputation, arising from your use of the platform.
Some jurisdictions do not allow limitations of liability, so these may not apply to you.
13. Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if necessary to protect the rights, property, or safety of Mechaverse or our users.
You may terminate your account at any time by deleting it through the platform. Upon any termination of your account (whether initiated by you or by us), your right to access and use Mechaverse will cease immediately. We will then permanently delete your personal data and content from our active systems. This deletion includes removal of any robot projects, repositories, images, or other content associated with your account (via a cascade deletion process). Once your account is deleted, neither you nor we will be able to recover any data or content you had provided.
Survival: Any part of these Terms that by its nature should survive termination of your account will continue to remain in effect. This includes, for example, ownership provisions, licenses granted by you, waivers, disclaimers of warranties, and limitations of liability.
14. Changes to Terms
We may modify these Terms from time to time. Updates will be effective upon posting with the “Last Updated” date at the top. For material changes, we will provide notice (e.g., via email or an in-platform alert). Continued use of Mechaverse after changes indicates acceptance of the new Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of France. If you are a consumer within the EU, you may have rights under your local mandatory consumer laws, which remain unaffected.
16. Dispute Resolution
We encourage resolving disputes amicably. If you have a concern, please contact us first at vmold@mechaverse.dev. Any unresolved dispute will be subject to the exclusive jurisdiction of the courts of Paris, France, unless applicable law requires otherwise. We may, at our discretion, agree to alternative dispute resolution methods (e.g., mediation or arbitration).
17. Miscellaneous
Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions of these Terms will remain valid and enforceable.
No Waiver: If we do not enforce any part of these Terms, it will not be considered a waiver of our right to enforce it later. Any waiver of compliance with these Terms must be made in writing.
Assignment: You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations to an affiliate or as part of a merger, acquisition, or other corporate transaction.
Entire Agreement: These Terms, together with any additional policies referenced herein (such as our Privacy Policy, Content Policy, and Code of Conduct), constitute the entire agreement between you and Mechaverse regarding your use of the platform. They supersede any prior agreements or communications between you and us relating to the subject matter of these Terms.
